DAYTON PLANNING BOARD
Regular Meeting


April 18, 2005

Absent: David Clark, Dan Kelley (Alternate)

Administrative Business:
Rose Hill called the meeting to order at 7:15 PM.
The March 21, 2005 Regular Meeting minutes were read and approved.

Old Business
No Old Business was discussed.

New Business
MORSE SUBDIVISION: Lisa and Steve Morse presented paperwork to the Board for a major subdivision next to Tara Estates on Dyer Road. At this time no formal application has been made and no preliminary plans have been presented. The Morses are proposing a five-lot subdivision. One lot has an existing house, one is a lot that was previously sold, and remaining three would be new lots. The Morses asked if they would be able to access part of the proposed development by having three driveways through Tara Estates and one new curb cut on Dyer Road. If that is not possible the other option is to have two new driveways and a road coming in from Dyer Road. They indicated that they had gone before the Tara Estates Association to ask if members had any objection to the first proposal, and they felt that most members were agreeable. Board members looked at the Tara Estates Deed Restrictions, Paragraph 10 to determine if this was possible. It was noted that in subdivisions of fifteen or more houses, a second egress is required. Tara Estates has fourteen houses. While this subdivision would not be part of Tara Estates, the Morses would require similar deed restrictions, association by-laws, and other specifics. The existing house would not be subject to these requirements.

Jim Roberts questioned if there would be enough land for five houses if a road comes in from Dyer Road. Board members felt that they need more information before making a decision. Rose Hill agreed to call the Maine Municipal Association and Town Attorney Maxine Pouravelis. Members asked the Morses to get a paper signed by the Tara Estates Road Association saying that the majority agrees to the Tara Estates Drive option.

HOUSING ORDINANCES: Selectmen Ed LeBlanc and Keith Harris met briefly with the Planning Board to discuss changes in the Town’s Ordinances. The Selectmen are willing to help write an amendment that encourages the building of housing for the elderly. Board members were in agreement and decided to research how other towns address this issue. Selectmen and Board members hope to have a proposed change on the November ballot.

The Selectmen also indicated that they have asked several residents about serving on the Planing Board.

The meeting was adjourned at 8:30 PM. The next regular meeting is scheduled for Monday, May 16, 2005, 7:00 PM at the Town Hall.
