OLD BUSINESS
ZONING DISTRICTS/LYLA KYRIAZI
Lyla Kyriazi brought in a map showing the Village District/Farm and Forest District boundary as following property lines behind the Laliberte property, in Kimball Estates. This is different than the information that Board members have received verbally. Board members are still trying to determine where the line is located, and looked at the map from Kimball Estates to see what had been determined at that time. Members looked also at the Map of Zoning Districts drawn in the 1970s.
Nancy Harriman went on record saying that she is stepping down as Chair on this issue as she is related to Lyla Kyriazi.
Nancy Harriman called Bill Harris, Chair of the Zoning Board of Appeals, to get his opinion. Bill felt that there is nothing definitive; he thinks that most of the land in question is in the village district. He wasn't sure if the land was ever surveyed. He said that the Board can make a determination and if anyone wants to challenge it, they can do so within 20 days.
Ron Wormwood called Amos Gay to get his opinion. Amos felt that the line on the Kyriazis’ map was not correct. Jim Roberts felt that line on that map was incorrect also. Amos felt that, in his opinion, the land was in the village zone.
Nancy Harriman informed the Selectmen that the Board feels a surveyor is needed to make a determination. Selectmen approved.
LEGAL COUNSEL REGARDING SDI
Nancy Harriman talked with Town Attorney Maxine Pouravelis regarding legal counsel on the proposed SDI retirement village. Maxine would like a copy of the Conditional Use Permit and noted that the gravel pit would have to be closed and reclaimed before this could begin. According to her legal counsel, there is no land there to approve for a motor home park, as it is still a gravel pit.
PROPOSED BUILDING MORATORIUM
Nancy Harriman talked with the Selectmen and was asked to set up a public hearing on the proposed building moratorium and proposed changes in the zoning ordinance. The moratorium does not affect the Kyriazis’ subdivision. The public hearing will be held on May 22, 6:30 PM at Dayton Consolidated School.
NEW BUSINESS
FEES
Members discussed updating fees. The following still needs approval from the Selectmen.
Conditional Use Permit Application fee: $400
Site Walk: $350 (both major and minor subdivisions and CUP applications)
Public Hearing: $350 (both major and minor subdivisions and CUP applications)
Minor/Major Subdivision Application: $400 per lot/dwelling unit
Flat fee of $400 to amend any subdivision plan
Retainer fee for independent consultation: $1000 in a special account, to be used if necessary by the Planning Board for independent consultation. Remainder to be returned to applicant.
PROPOSED AMENDMENTS TO THE ZONING ORDINANCE
Jim Roberts handed out Proposed Amendments to the Dayton Zoning Ordinance as written by Amos Gay in May 2005. Members debated the definition of a “Dead End Street” with its proposed length of 1000 feet. Members informed the Selectmen that they did not agree with the length; Selectmen agreed. Members discussed requiring that a road be wider as it increases in length.
Jim Roberts noted that so far the Planning Board has not been requiring subdivisions to put aside land for open space or put aside money for a land acquisition fund.
AGENDAS
Members discussed limiting the number of agenda items per meeting and completing one application/project before starting another. Applicants may also be asked to limit their presentation time as appropriate.
SUBDIVISION CHECKLIST
Board members were given a copy of the subdivision checklist and asked to review it during the next two weeks and suggest appropriate changes.
Meeting adjourned at 9:10 PM. The next meeting is scheduled for Monday, May 1, 2006 at 7:00 PM.
