Andy Morrell of BH2M presented the Board with a copy of a letter from Thomas Milligan, PE.
He summarized the following changes on the plans:
·       Note 18 demonstrates all three waivers granted by Planning Board.
·       Note 20 has been added to Sheet 1, stating that Whispering Willows Lane will forever remain a private way
·       Location of the fire tank on Lot 4 was added to the plans
·       The applicant will submit an updated homeowners association document under separate cover
·       The applicant sent plans to Tom Milligan, PE for review of erosion control measures and the plans have been revised based on the recommendations of Mr. Milligan

Nancy Harriman reviewed the comments provided by Mr. Milligan. It was noted that the town Plumbing Inspector was not present.

Andy Morrell showed Sheet 3 of the plans, which details the slope of the road. There is a concern as to whether the flow of water will erode the ditch. To address that, rip-rap has been extended up the hill along with a mat at the bottom of the ditch to control erosion. Sheet 3 also shows a stone entrance so that mud from vehicle tires does not add to problems.  Each side of road has a ditch; the circles on the map show stone check dams to slow the water down and allow it to percolate. Jim Roberts noted that there were problems already that needed to be stabilized so as to not add more water.

The following points were noted in Mr. Milligan’s letter:
·       Comment 3: The stone check dams should be relocated as detailed in the letter
·       Comment 4: The existing culvert on Lot 3 does not have rip rap, it should be installed at the inlet and outlet
·       Comment 5: (related to Comment 3) rip-rap should be used in the vegetated ditches to control erosion.
·       Comment 6: Drainage and erosion/soil control details should be provided on Sheet 4 where the fire tank was added to Lot 4. (The ditch has been upgraded and relocated to drain further down on Frasier’s land.)
·       Comment 7: Addresses the use of erosion control mix (mulch) and addresses the need to indicate the proper slope on the plans
·       Comment 8: Suggests a detail on the rip rap slope to address how it goes into the ground
·       Comment 9: Suggests clarification on the plans indicating where erosion control mix is proposed

Nancy asked for questions or concerns.

Dick Hall asked if the hammerhead would be developed as part of the road. Andy explained that it would be located as shown on the plans and built to the same standards as the road.

John Gay asked for the number of lots. Andy explained that there are seven lots, three existing and four new lots. Lot 7 is labeled as being retained by the owner and is projected for Phase 2, which has no definite plans at this time
Nancy asked how many people live there now. Andy counted four; Jim Roberts explained that they had been there more than five years.

John Gay asked why Mr. Milligan had been hired. Pat Frasier and Andy Morrell explained that SCS could not get a response letter back in the time required before the public hearing. John Gay noted that Milligan used to work for BH2M. Pat responded that he had met him through excavation work, before his relationship with BH2M. Jim Roberts asked if Pat would get another letter from SCS in case of conflict.

Nancy noted that there was no vote tonight, and the Board would have to discuss whether or not Pat needed to go to SCS as there is the potential for conflict of interest. The Board will decide what to do at the next meeting.
Dick Hall asked John Gay if he was concerned about a possible conflict of interest. Mr. Gay indicated that he had no particular concerns, just found it interesting. Andy noted that if there were concerns they would be willing to address it, and added that Milligan also did the wetland study and is a licensed engineer.

Bill Darrah asked about the crossing of the road in front of Mrs. White’s property. Pat explained that there would be a change in the grade, but he is limited because he doesn’t own that property. He would like to flatten out the grade to improve the road, but Mrs. White would have to give him that property. Bill Darrah expressed concern as to whether fire trucks could handle the grade, Pat and Andy indicated that they could. Andy explained that the dip would not be as steep as it is now and the slope in front of Darrah’s house would decrease. He noted that the right-of-way has been maximized. Nancy asked if Mrs. White has declined to give more property; Pat indicated that she has.

Nancy declared the public hearing over at 7:10. The public was invited to stay during the Board’s workshop meeting.
